This Privacy Policy is a legally binding agreement between you ("User," "you," or "your") and the Company. By accessing and using the Performidi Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. This Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), User Agent Data, browser type, browser version, the pages of our Performidi Platform that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Performidi Platform by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device's unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
We may use and store information about your location if you give us permission to do so (“Location Data”). We may use this data to provide features of our Performidi Platform to improve and customize our Performidi Platform.
We use cookies and similar tracking technologies to track the activity on our Performidi Platform and hold certain information. Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Performidi Platform. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may be unable to use some portions of our Performidi Platform.

We collect Machine Learning Training Data to enhance our services, including MIDI data, audio, and user reviews. This data helps train our machine learning-based software. By using our services, you agree to the collection and utilization of Machine Learning Training Data as outlined in this Privacy Policy. Your use doesn't require explicit approval for this data collection. We take the security of Machine Learning Training Data seriously, implementing measures for protection, assessment, and regular updates. Data is retained as outlined unless a longer period is required by law, after which it's securely deleted.

While we use Amazon Web Services (AWS) we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
All user information requires authentication, meaning that users must provide their login credentials (e.g., username and password) to access their account. This helps to prevent unauthorized access to user data. Sensitive personal information is never shared between accounts. Sessions are managed with JWT tokens. JWT tokens are a secure way to store user information during a session. They are digitally signed and encrypted, and they can only be decoded by the server that issued them. This helps to protect user data from being intercepted or tampered with. User information is stored in the cloud in an Amazon RDS instance accessed solely through our Amazon EC2 instance. Amazon is a secure and reliable cloud computing platform. It offers a wide range of security features, including encryption, access control, and intrusion detection. We also use a web application firewall (WAF) to protect our web app from common attacks, such as cross-site scripting (XSS) and SQL injection, and we conduct regular security audits to protect user information from unauthorized access.
We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting your web browser's Preferences or Settings page. In addition to the rights, as explained in this Policy, California residents who provide Personal Information (as defined in the statute) to obtain products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information about the Personal Information we shared, if any, with other businesses for marketing uses. We may employ third-party companies and individuals to facilitate our Performidi Platform (“Service Providers”), to provide the Performidi Platform on our behalf, to perform Performidi Platform-related services or to assist us in analyzing how our Performidi Platform is used. These third parties may have access to some of your basic Personal Data only to perform these specific tasks on our behalf and are obligated not to disclose or use it for any other purpose.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
Our Performidi Platform is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Performidi Platform.
